Wills, Executries and Powers of Attorney

Our Wills and Executries Department is managed by Lisa MacIntyre who is assisted by Donna Clark. They both specialise in and have considerable experience in these areas of law. Please contact them for further information.

Wills

This can be a very sensitive area for many people, but that need not be the case. The reality of making a Will is far less daunting than you may think. By making a Will, you can ensure that your affairs are in order and that your family and loved ones have been properly provided for. Failure to leave a Will can have very serious consequences and result in your Estate being distributed in a way that you may not have wished, so it is essential that you seek proper professional advice.

Indeed, wills can form part of long term financial planning for clients and we are only too happy to help in this area.

Making a Will is neither difficult nor expensive. INNES & MACKAY have a wealth of experience in this area and are well placed to help you. Wills can be used for effective Inheritance Tax Planning, where necessary, so that your affairs are left in the most tax efficient manner.

Executries and Trusts

We also have experienced and qualified staff to assist in the administration of the Estate of a person who has passed away. This is a very difficult time for those left behind and we offer a sensitive and caring approach. We are also experienced in the complex and diverse constitution and administration of trusts, for those of you with more complicated affairs. Our professional relationships with well respected local accountants, stockbrokers and Independent Financial Advisors will help us to help you.

Powers of Attorney

Most people are unaware of the importance of granting a Power of Attorney.  Should anything happen and you are unable to look after your own affairs, whether this is a medical problem or as a result of an accident, your family will be unable to attend to your affairs without a Power of Attorney.  If there is no Power of Attorney in place a Guardian may have to be appointed which is a complex procedure involving a court order and may run into thousands of pounds.  This can be avoided by granting a Power of Attorney during your lifetime.  Some of the most basic decisions cannot be made for you if you have not granted a Power of Attorney.
